Welcome to Thamarai Foods & Trading Private Limited (“Thamarai”, “we”, “us” or “our”).
These Terms & Conditions (“Terms”) govern your use of our restaurant services, including dine-in, take-away, and online ordering services (collectively, “Services”). By visiting our premises, placing an order via our website or mobile interfaces, or using our Services in any way, you agree to be bound by these Terms.

All food products served or sold comply with the Food Safety and Standards Authority of India (FSSAI) regulations, and all applicable taxes are collected under the Goods and Services Tax (GST) Act.

1. Agreement and Acceptance

1.1 These Terms form a legally binding contract between you (“you”, “customer”, or “guest”) and Thamarai.
1.2 By ordering or using Services, you represent that you are at least 18 years old and legally capable of entering into binding contracts.
1.3 All orders placed are treated as an offer to purchase products at the price published at the time of ordering, and we may accept such offer at our discretion.

2. Orders, Payments & Contract Formation

2.1 Orders placed online or via other channels are subject to confirmation by us. An order is accepted only when we send a confirmation message or begin preparation.
2.2 You must provide accurate contact, address, and payment details. Inaccuracies may delay or cancel your order.
2.3 All prices include applicable taxes unless otherwise stated. Final billing will reflect applicable GST and charges.

3. Cancellations & Refunds

3.1 You may request cancellation before the order is accepted. Once accepted or prepared, cancellation is at our discretion and subject to refund policies.
3.2 Refunds will be processed using the original payment method unless otherwise agreed.

4. Quality, Food Safety & Compliance

4.1 We comply with all applicable food safety regulations in India, including the Food Safety and Standards Act and related standards for food handling, hygiene, and preparation.
4.2 While we aim to serve food as described, minor variations in presentation are normal.

5. Supply Chain & Trading

5.1 Our supply chain is built from the ground up, entirely in-house, giving us full control over sourcing, imports, production, and distribution.
5.2 Trading is deliberate and restrained — an extension of our manufacturing philosophy, ensuring that every ingredient and product meets our standards of quality, traceability, and integrity.

6. Use of Services

6.1 You shall use our Services lawfully and not in any way that violates applicable Indian law, including anti-fraud, anti-spam, and consumer protection statutes.
6.2 You agree not to misuse our digital platforms or engage in behaviour that disrupts operations, harasses staff, or violates laws.

7. Liability & Disclaimers

7.1 To the extent permitted by law, we shall not be liable for indirect, incidental, special, or consequential losses arising from your use of our Services.

7.2 Allergen and Food Safety Notice

All products are labelled with allergen information where applicable; however, we do not operate in a nut-free or allergen-free facility. As such, there is a risk of cross-contamination with nuts and other allergens. We do not accept liability for adverse reactions caused by allergens. Individuals with severe allergies are advised not to consume our products and to seek independent advice before purchasing .Consumption of our products is at the customer’s own risk.
7.3 We are not liable for delays or failures due to circumstances beyond our control (e.g., delivery partner delays, traffic, weather).
7.4 Nothing in these Terms waives any statutory rights afforded to you under Indian law, including rights under the Consumer Protection Act.

8. Intellectual Property

8.1 All content, branding, names, logos, and materials used in connection with our Services are owned or licensed by Thamarai.
8.2 You may not use our intellectual property without prior written consent.

9. Data & Privacy

9.1 We collect personal information as necessary to provide Services and as described in our Privacy Policy. By using our Services, you consent to this collection and use.
9.2 You agree to protect your login and account credentials and notify us of any suspicious use.

10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of India, including contract law under the Indian Contract Act, 1872, and relevant consumer law.
10.2 Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of courts in the city where the restaurant is registered.

11. Amendments

11.1 We reserve the right to amend these Terms at any time. Changes will take effect once posted on our website or communicated via the Services.
11.2 Continued use of our Services after such changes constitutes acceptance.
